General Terms and Conditions of Sale for the establishment "Les Jardins de Camelot"

 

Article 1 : Purpose This contract is intended to define all the rights and obligations of the parties within the framework of the rental of guest rooms between our establishment, Les Jardins de Camelot, located at 40 route de Camelot, 33141 Villegouge, and the guests wishing to stay there. The guest acknowledges having read and accepted these general terms and conditions of sale and the related pricing conditions. No specific conditions communicated by the guest may be incorporated into our general terms and conditions. We may modify or supplement our general terms and conditions of sale at any time. As soon as the new version of the general terms and conditions of sale is published online, it applies tofuture customers.

Article 2: Commitment The best possible welcome will be extended to guests. The owner is committed to ensuring their reception with all the necessary attention to facilitate their stay and their exploration of the region.

Article 3: Length of Stay We will be delighted to welcome you on the dates specified in your reservation. This reservation is for a fixed period and under no circumstances will it entitle our guests to any right to remain on the premises once this period has expired.

Article 4: Booking The customer chooses the services presented on our website: www.lesjardinsdecamelot.com . The client acknowledges having read and understood the nature, purpose, and booking procedures for these services and having requested and obtained the necessary information to make an informed booking. The client is responsible for choosing the services and ensuring their suitability for their needs; therefore, we cannot be held liable in this regard. The booking is deemed accepted by the client upon completion of the booking process.

Article 5: Reservations made by telephone, email, or post. Your reservation becomes effective once you have confirmed it in writing, accepted these terms and conditions, and sent us the payment for your stay,  by a bank transfer. Prices are all-inclusive, except for breakfast, which is optional, to be ordered on the day of your arrival, and paid for on site.

Article 6: Reservations made via the website www.lesjardinsdecamelot.com   The booking is confirmed upon receipt of the booking confirmation. The client agrees to complete the requested information on the booking request and attests to its truthfulness and accuracy. After selecting the services to be booked, the client reviews and accepts these terms and conditions and the corresponding price. The client then confirms their booking and accesses our payment provider's platform, "elloha," via "stripe.com" to pay online for the chosen service.

Article 7: Prices The prices indicated and confirmed to the customer are in euros and valid for the period indicated on the establishment's website: www.lesjardinsdecamelot.com . VAT is not applicable, according to Article 293 B of the French General Tax Code. All reservations are payable in euros. Any exchange fees charged by banks during the transaction are the responsibility of the customer. Breakfast is not included in the room price but can be booked online. Tourist tax is included in the price. Any changes to or introduction of new taxes imposed by the relevant authorities will be automatically reflected in the prices shown on the invoice date.

Article 8: Payment The establishment accepts the following payment methods: bank transfer and credit card. For direct bookings made in writing or by telephone, the client will be asked to send the establishment a bank transfer to confirm their reservation. For online bookings made via the website: www.lesjardinsdecamelot.com The customer must pay immediately with their bank card. The validity of the customer's payment card is verified by "stripe.com". A payment card may be declined for several reasons: stolen card, blocked card, spending limit reached, incorrect entry, etc. In case of a problem, the customer should contact their bank and the establishment to confirm their reservation and payment method. The balance of services is due upon the customer's arrival and can be paid using one of the methods specified in these Terms and Conditions. In case of no-show or late cancellation, the deposit remains fully with the establishment.

Article 9: Booking Confirmation Our website www.lesjardinsdecamelot.com We will acknowledge receipt of your reservation by promptly sending an email summarizing: the services booked, the price, the amount and payment method of the deposit paid, the terms and conditions of sale accepted by the client, the address of the establishment, and the authorized arrival and departure dates and times. For any further information, the client may contact the establishment directly by email or telephone.

Article 10: No Right of Withdrawal For reservations made by mail, telephone, or internet, the customer does not have a right of withdrawal, in accordance with Article L221-28-12 of the French Consumer Code, which relates in particular to accommodation services provided on a specific date or at regular intervals. 

Article 11: Cancellation by the Customer Any cancellation must be notified as soon as possible by telephone or email addressed to the establishment:

a) Cancellation before the start of the stay: if the cancellation occurs less than one month before the start of the stay, the amount already paid remains fully acquired by the establishment.

b) If the cancellation occurs more than one month before the start of the stay, the establishment will refund the visitor 50% of the amount paid.

c) In the event of a shortened stay, the price corresponding to the initial stay remains fully payable to the establishment.

Article 12: Cancellation by the establishment When, before the start of the stay, the establishment cancels this stay, it must inform the client as quickly as possible by all written and oral means. The customer will be immediately reimbursed for the deposit paid and the establishment may offer them an alternative accommodation solution.

Article 13: Arrival The client must arrive on the specified date and during the opening hours previously agreed upon between them and the owner. In case of late or delayed arrival, the client must notify the establishment as soon as possible. Self check-in can then be arranged.

Article 14: Tourist tax The tourist tax is a local tax that the client must pay to the owner who then forwards it to the Public Treasury.

Article 15: Use of the Premises The Camelot Gardens are a place for quiet and peaceful stays. The establishment is not intended for parties or receptions. Guests must respect the peaceful nature of the premises and use them in accordance with this purpose. Any behavior contrary to public decency and order will result in the establishment asking the guest to leave the premises without any compensation or refund. The guest agrees to abide by the house rules of Les Jardins de Camelot and to return the rooms in a tidy and clean condition. They must report to the owner any incident resulting in damage to the rooms, bedding, or common areas. When using the common areas, guests must leave them in a tidy and clean condition so that other visitors can also enjoy them peacefully.

Article 16: Capacity This contract is established for a specific number of people. If the number of visitors exceeds this number, the owner is entitled to refuse entry to the additional customers or to apply an increase to the agreed price. This cannot in any way be considered as a modification or breach of contract initiated by the owner, so in the event of early departure of all or part of the visitors, no refund can be considered.

Article 17: Pets Pets are not allowed on the premises, except with the prior agreement of the owner. In this case, the pet must not, under any circumstances, be left alone and unattended on the rented premises. If the client fails to comply with this clause, the owner may refuse the pets. This refusal cannot under any circumstances be considered a modification or breach of contract by the owner, and therefore, in the event of the client's departure, no refund will be given.

Article 18: ResponsibilityThe establishment cannot be held liable for the non-execution or improper execution of the reservation in cases of force majeure, actions of third parties, or actions of the client, including but not limited to internet network unavailability, inability to access the website, external intrusion, computer viruses, or unauthorized prepayment by the cardholder's bank. Any reservation or payment that is irregular, invalid, incomplete, or fraudulent for a reason attributable to the client will result in the cancellation of the order at the client's expense, without prejudice to any civil or criminal action against the client.

Article 19: Privacy Policy On each personal data collection form, the customer is informed whether responses are mandatory or optional by the presence of an asterisk. The information processed is intended for the establishment and its online payment provider, "Elloha," which uses the "Stripe.com" platform. The customer authorizes the establishment to share their personal data provided that such sharing is necessary for the establishment to fulfill its obligations under these terms and conditions and in accordance with the Customer Personal Data Protection Charter. Specifically, for online payments, the customer's bank details must be transmitted by the payment provider "Stripe.com" to the establishment's bank for the execution of the booking contract. The customer is informed that this data transfer may therefore take place in foreign countries that do not have adequate personal data protection as defined by the French Data Protection Act (Loi Informatique et Libertés). However, the customer consents to this transfer, which is necessary for the execution of their booking. Constellation SAS / Stripe.com, acting in their professional capacity, have committed to the establishment to take all necessary security measures and ensure the confidentiality of data for these data transfers.

Article 20: Evidence Agreement The entry of the required bank details, as well as acceptance of these terms and conditions and the booking confirmation or request, constitutes an electronic signature which, between the parties, has the same legal value as a handwritten signature. The computerized records stored in Elloha.com's computer systems will be kept under reasonable security conditions and considered proof of communications, orders, and payments made between the parties. The customer is informed that their IP address is recorded at the time of booking.

Article 21: Disputes Any complaint during the stay must be made immediately and in good spirits to the owner, so that she can try to find a solution to the problem. Any claims the client wishes to make after their departure must, under penalty of forfeiture, be submitted to us in writing within fourteen days of the departure date from the establishment. These provisions do not preclude any legal action that may be taken by the client or the owner. These General Terms and Conditions of Sale are governed by French law, without prejudice to any mandatory protective provisions that may apply in the client's country of residence.
